Please read these Terms of Service carefully before using the platform. By accessing or using the website or any of our services, you acknowledge that you have read, understood, and agree to be legally bound by these terms and conditions in full. If you do not agree to these terms, you must not access or use the platform.

1. Introduction

Welcome to Trade Up Funding ("Trade Up Funding," "we," "our," or "us"). Trade Up Funding operates a secure online platform that offers:
  • Binary options trading tournaments, where users may compete for real monetary prizes by demonstrating skill, discipline, and trading performance.
  • Simulated prop trading challenges, designed solely for practice and educational purposes, without the distribution of any real-world funds or financial rewards.
All services are provided through our primary website (https://tradeupfunding.com) and operational tournament portal (https://challenge.tradeupfunding.com), collectively defined as the "Platform."

Use of the Platform is voluntary and limited strictly to individuals who are eighteen (18) years of age or older, or who have reached the legal age of majority in their place of residence. By using the Platform, you confirm that you are eligible to enter this binding agreement (the "Agreement") and agree to all applicable terms set forth herein.

2. Eligibility

2.1 To register and participate, users must:
  • Be at least eighteen (18) years old or the legal age of majority in their jurisdiction.
  • Not be located in or a resident of a jurisdiction where such services are restricted or unlawful.
  • Possess the full legal right and ability to enter into binding contracts.
  • Not be on any trade restriction, sanctions, or denial list maintained by any regulatory authority.
2.2 You are solely responsible for determining whether accessing and using the Platform complies with the laws and regulations in your country or jurisdiction. We reserve the right to deny access to any person at our sole discretion.
2.3 By creating an account, you represent and warrant that all registration details are truthful, accurate, and complete. Misrepresentation may result in immediate account termination.

3. Account Registration

We may collect the following categories of personal data:
  • Provide complete and accurate registration information.
  • Maintain the confidentiality of their login credentials.
  • Immediately notify us of any unauthorized use of their Account.
3.2 You may not share, sell, or otherwise allow another individual to access or use your Account. You are solely responsible for all activities conducted through your Account.

3.3 We reserve the right to suspend or permanently terminate any Account if, in our sole judgment, we suspect fraud, abuse, multiple accounts by one user, or any violation of this Agreement.

3.4 Maintaining the integrity of the platform requires compliance. Account termination forfeits access to all services, data, and unpaid prizes.

4. Service Overview

4.1 Trading tournaments:
  • Simulated competitions that mimic live binary options trading using virtual capital.
  • Participation may be free or require payment of a non-refundable entry fee.
  • Tournaments are scored based on publicly disclosed metrics such as win percentage, profitability, and streak performance.
  • Only the top three (3) ranked users in each tournament are eligible for real cash prizes, subject to verification.
4.2 Simulated prop trading challenges:
  • These are purely educational simulations.
  • No real money is awarded or exchanged.
  • Participants may qualify for continued access to a simulated funded environment as a recognition of performance.
  • These challenges are useful for refining strategies and developing discipline without financial risk.
4.3 All activity is conducted in a demo environment. Trade Up Funding is not a broker and does not facilitate access to live markets. No financial instruments or assets are traded.

5. Fees and Payments

5.1 Some tournaments and challenges require entry fees. All pricing is clearly displayed during registration.

5.2 All fees are non-refundable, even in cases of disqualification, account suspension, system errors, or user withdrawal.

5.3 You agree to use only payment methods authorized for use and owned by you. Any attempt to use fraudulent payment methods may result in permanent account suspension and legal referral.

5.4 We are not responsible for any processing delays, banking issues, or third-party payment service disruptions.

6. User Conduct

6.1 Users must behave ethically and in good faith at all times. Prohibited activities include:
  • Attempting to manipulate results through bots, collusion, automation, or latency exploitation.
  • Operating multiple accounts to circumvent rules or gain unfair advantage.
  • Abusing system features, submitting falsified information, or impersonating another person.
  • Harassing, threatening, or discriminating against other users or staff.
  • Disrupting platform operations or attempting to reverse-engineer system architecture.
6.2 Trade Up Funding retains full rights to investigate misconduct and apply corrective actions, which may include forfeiture of prizes, disqualification, account termination, legal action, or any combination thereof.

6.3 In the interest of fair competition, we reserve the right to disqualify users at any time if we determine—at our sole discretion—that activity is inconsistent with a fair, competitive, and honest tournament environment.

7. Intellectual Property

7.1 All trademarks, software, images, layout, functionality, and content available through the Platform (collectively, the "Intellectual Property") are the exclusive property of Trade Up Funding or its licensors.

7.2 You may not use, reproduce, duplicate, distribute, display, publish, license, modify, or create derivative works based on the Platform or its Intellectual Property without prior written consent.

7.3 Any unauthorized use of the Intellectual Property is a violation of this Agreement and may result in legal action and termination of your rights.

8. Termination

8.1 We may suspend or terminate your access to the Platform at any time, without prior notice, if:
  • You violate any part of this Agreement.
  • You fail to complete or pass KYC verification when attempting to claim a prize.
  • Your activity is deemed harmful, fraudulent, or abusive.
  • Required by applicable law or regulatory authority.
8.2 Upon termination:
  • All active sessions will be revoked immediately.
  • Unclaimed prizes may be voided.
  • You will lose access to all platform data, features, and content.
  • Any remaining funds, virtual balances, or simulated performance data will be removed.
8.3 Termination does not relieve you of any obligations or liabilities incurred prior to the date of termination.

9. Disclaimer of Warranties

9.1 The Platform is provided "as is" and "as available," without warranties of any kind. To the fullest extent permissible under law, we disclaim all express, implied, and statutory warranties.

9.2 Trade Up Funding does not guarantee that the Platform will be uninterrupted, timely, or error-free.

9.3 We make no guarantee as to the results of any tournament or challenge, and participants acknowledge that all trading results are based on simulated conditions and do not reflect live market risks.

10. Amendments

10.1 Trade Up Funding reserves the right to revise or modify these Terms at any time. Users will be notified of changes through the Platform or by email where appropriate.

10.2 Revisions will take effect immediately upon publication unless stated otherwise. It is your responsibility to regularly review this Agreement for updates.

10.3 Continued use of the Platform following such changes constitutes your acceptance of the modified Terms.
